ODR: Online Dispute Resolution

Several months ago, I began doing telephonic mediations as an alternative to our traditional and long established way of resolving cases. It came with great success for those who were willing to give it a try. The COVID-19 pandemic is forcing everyone to use video conferencing as the replacement to “in-person” meetings.


After doing several video conferencing mediations in a row, I am simply AMAZED at how successful the process is. The first key to success is a person’s Wi-Fi capabilities. Be sure your connection is secure and strong! If the Wi-Fi is adequate, then the audio and visual problems are nonexistent!

A few other tips:


  • Make sure the participants take a break from other work or distractions and “reserve the time” as needed for the mediation.


  • To ensure the confidentiality of the process Do not allow the participants to be in a place (Starbucks, the library, McDonald’s, etc.) where others are congregated.


  • Be in an interruption-free zone!


  • Have a cell number or contact information of the host mediator in case of technological failures or hiccups!
